Road traffic accident – over 700.000 PLN settlement

BFP has recently represented a client in a personal injury case following a serious road traffic accident that occurred in 2012 in Gdynia, Poland. The parties injured in said accident – including our law firm’s client – were citizens of the United States of America, as well as soldiers from the elite Navy SEAL force.

BFP has recently represented a client in a personal injury case following a serious road traffic accident that occurred in 2012 in Gdynia, Poland. The parties injured in said accident – including our law firm’s client – were citizens of the United States of America, as well as soldiers from the elite Navy SEAL force.

Our law firm’s client unfortunately sustained the most serious injuries out of all of the participants. These injuries included, among others, brain damage that despite rigorous and lengthy treatment and rehabilitation, has unfortunately resulted in aphasia. Aphasia is a serious disorder that mainly affects the ability to speak and read fluently. Extensive treatment and rehabilitation has thankfully improved our client’s condition, however the disorder is permanent, and there are currently no positive outlooks in regard to achieving a full recovery.

BFP represented our client in pre-court settlement negotiations with the insurance company in which the tortfeasor’s vehicle was insured at the time of the accident in regard to third-party civil liability insurance. The tortfeasor was a citizen of Germany, and likewise the insurer was also a German-based company. The settlement negotiations were successful as both parties agreed to settle the case through an out-of-court agreement on the basis of which the insurance company was obliged to pay 175.000,00 EUR (approximately 722.000,00 PLN) in favor of our client as redress for his non – pecuniary damages. Thanks to this resolution our client was able to both obtain compensation for his personal injury, as well as avoid a lengthy and expensive civil trial before a Polish court.
