Att. Jolanta Budzowska represents the Polish resident who, due to a traffic accident in Great Britain, will shortly be paid considerable compensation by UK-based insurer. The compensation will consist of the redress for non-pecuniary damages, pecuniary damages and lifelong periodical benefits paid to the injured party. The traffic accident that the injured party participated in resulted in his health deterioration and in his partial incapacitation before the Polish Family Court. The latter, in turn, provoked the necessity of a complex legal assistance rendered to the injured party’s guardian.
The case at issue generates a number of complex legal issues at the border of Polish and English law. Hence, due to the outstanding experience of Att. Jolanta Budzowska and Att. Małgorzata Kiełtyka in handling cross border cases, a leading British law firm authorised Budzowska Fiutowski and Partners to act on behalf and in the name of the incapacitated person as well as the guardian before the Polish Family Court.
Att. Jolanta Budzowska and Att. Małgorzata Kiełtyka advised in this respect in a number of issues connected with obtaining the consent of the Polish Family Court to undertake the legal acts that exceed day-to-day management of the incapacitated person’s assets, like the consent to conclude the settlement with the UK-based insurer, to make expenses to meet the increased needs of the incapacitated or to purchase a real property in his name and on his behalf. The legal assistance of BFP covered also a regular support in respect of cross border aspects of the case, like interpretation of the Polish provisions, contact with case managers and analysing tax issues. In the subsequent stage of the case, Att. Jolanta Budzowska will be also actively involved in arranging an investment adviser who will provide professional assistance in respect of the investment of the funds due to the incapacitated person and will supervise and manage all the required procedures, including the need to obtain the relevant consent of the Polish Family Court in this respect.
Through its international practice, BFP gains expertise in complex cross-border cases. The assistance in such cases is also rendered by Att. Jolanta Budzowska in the form of providing medico-legal opinions at the expert level.
