The emergence of the class action in the Polish legal system in July 2010 was accompanied with a big media hype and the opinions that there will be particular industries among entrepreneurs that due to their specific activities should be especially interested in the new regulation, such as banking, property development and pharmaceuticals. The practice has shown, however, that the Act does not meet the assumptions of its creators, and the problems with making use of the new regulations arise already at the stage of fulfilling the conditions for the admissibility of making a claim under the said Act. Currently, class actions are a popular form of pursuing compensation for victims, particularly in the U.S. and other countries based on common law system. This is due, inter alia, to a different catalogue of cases protected by the provisions governing the claims pursued on the basis of class action.
